Otoritas Jasa Keuangan telah menetapkan aturan baru bagi penagih utang atau debt collector pinjaman online (pinjol) peer-to-peer (P2P) lending, sebagai bagian dari peta jalan Lembaga Pendanaan Bersama Berbasis Teknologi Informasi (LPPBBTI). Kepala Eksekutif Pengawas Lembaga Pembiayaan, Perusahaan Modal Ventura, Lembaga Keuangan Mikro dan Lembaga Jasa Keuangan Lainnya (PVML) OJK Agusman mengatakan setiap penyelenggara wajib menjelaskan terkait prosedur pengembalian dana kepada debitur atau nasabahnya.
Selain itu, juga terdapat ketentuan dan etika dalam proses penagihan. Penyelenggara P2P lending dilarang menggunakan ancaman, bentuk intimidasi, dan hal-hal negatif lainnya termasuk unsur SARA dalam proses penagihan.
Bahkan, OJK juga mengatur waktu penagihan bagi para penyelenggara kepada debitur maksimal hingga pukul 20.00 waktu setempat.
“Jadi tidak 24 jam. Maksimal sampai jam 8 malam,” ungkapnya.
Penyelenggara dilarang menggunakan ancaman, bentuk intimidasi, dan hal-hal negatif lainnya termasuk unsur SARA dalam proses penagihan.
OJK juga melarang penagih melakukan intimidasi dan merendahkan suku, agama, ras, dan antargolongan (SARA), harkat, martabat, dan harga diri, di dunia fisik maupun di dunia maya (cyber bullying) baik kepada debitur, kontak darurat debitur, rekan, hingga keluarga.
Terakhir, Agusman juga menegaskan, para penyelenggara wajib bertanggung jawab terhadap semua proses penagihan. Artinya, debt collector atau jasa penagih yang memiliki kontrak dengan pihak penyelenggara berada di bawah tanggung jawab penyelenggara.
“Jadi kalau ada kasus bunuh diri, penyelenggara bertanggung jawab,” pungkasnya.
Sebagaimana diketahui, road map ini sejalan dengan amanat Undang-Undang No.4 tahun 2023 tentang Pengembangan dan Penguatan Sistem Perbankan (UU PPSK).
Adapun Pasal 306 UU PPSK mengatur jika pelaku usaha sektor keuangan (PUSK) melakukan pelanggaran dalam penagihan hingga memberikan informasi yang salah kepada nasabah akan dipidana penjara paling singkat 2 tahun dan paling lama 10 tahun dan pidana denda paling sedikit Rp 25 miliar dan Rp 250 miliar.
Untuk menghadapi para debt collector, berikut caranya:
1. Tanyakan Identitas
Saat debt collector datang, sambutlah dengan sopan dan tanyakan identitas mereka. Ketahui juga soal identitas debt collector, mulai dari siapa yang memberi perintah penagihan dan kontak pemberi tanggung jawab.
2. Minta Menunjukkan Kartu Sertifikasi Profesi
Para debt collector resi akan mendapatkan sertifikat Asosiasi Perusahaan Pembiayaan Indonesia atau APPI. Ini bertujuan agar penagih utang dapat menunjukkan bukti aktivitas profesinya.
3. Jelaskan Alasan Keterlambatan dengan Baik
Nasabah harus menjelaskan secara baik alasan terlambat atau menunggak membayar utang. Anda juga perlu menambahkan akan menghubungi pihak pemberi pinjaman soal utang tersebut.
Ingat juga jangan menjanjikan apapun pada debt collector untuk memperpanjang masa penagihan pinjaman. Ini bisa membuat proses penagihan menjadi semakin rumit.
4. Cari Tahu Surat Kuasa Penagihan Jika Ada Penyitaan Barang
Surat kuasa adalah bukti barang sitaan imbas penunggakan bayar utang dapat diambil. Ini wajib diterbitkan oleh penyedia pinjol tempat pinjaman diajukan.
5. Penyitaan Disertai Sertifikat Jaminan Fidusia
Lihat juga adanya sertifikat jaminan fidusia. Bentuknya adalah dokumen asli atau penyitaan barang. Jika debt collector tidak dapat menunjukkan sertifikat tersebut, tolak aktivitas penyitaan.
